Meeting Minutes
FEBRUARY 26, 2019
Opening:
The special public meeting of the Zoning Board of Adjustment of the Village of Ridgewood was called to order at 7:40 p.m.
Present: Sergio Alegre, Greg Brown, Gary Negrycz, Alyssa Matthews, Ines Bunza, Jonathan Papietro, Isaac Lebow and Matthew Bandelt. Also present were Bruce Whitaker, Esq., Board Attorney and Jane Wondergem, Board Secretary.
Absent: Diana Ruhl
Approval of Minutes: The minutes of February 11, 2019 were adopted as presented.
Resolution memorialization: The following resolutions were memorialized:
- McKenna, 416 Colonial Road – extension of variance approval
- Gomez-Dueso and Gelnaw, 85 Pershing Avenue
Chairman Alegre announced the following:
- Robin Oelkers, 42 Ethelbert Place, was carried to March 26, 2019 without further notice.
- Terrence Robinson and William Hall, 151 West End Avenue, was carried to March 12, 2019 without further notice.
Non-agenda items:
Board member comments: There were no comments at this time.
Members of the public comments: Arthur Maroney, 390 Heights Road, commented on issues regarding construction and grading that was approved at a neighboring property and invited the Board members to visit his property.

Old Business:
TODD & HEATHER HOLDER – An application to permit a 2 ½ story addition which will result in a side yard setback of 14.99 feet, where 19.14 feet is required at 22 Maynard Court, Block 2403, Lot 4, in the R-1 Zone. (Continued from February 11, 2019 without further notice) Ms. Matthews recused herself from this hearing. Heather Holder, homeowner, was sworn. Enrico Migliorelli, architect, was previously sworn and testified regarding the revised chart which was submitted with the added square footage for attic space. There were no questions from the Board or the public. There were no comments from the public. Following Board deliberation Mr. Negrycz made a motion to approve, Mr. Papietro seconded, and all members voted yes to approve the application.
KEVIN & JENNIFER HOGAN – An application to construct a front portico, a rear 2-story addition and a rear covered deck which will result in a side yard setback on the left of 10.1 feet to the first floor and 10.2 feet to the 2nd floor; side yard setback on the right of 7.3 feet to the chimney, and 10 feet to the addition, where 18 feet is required; combined side yard setback of 16.46 feet, where 16.5 feet is required; coverage by above-grade structures of 20.5%, coverage by above-grade structures within 140 feet of the front lot line of 21.5%, where 20% is permitted for both; coverage by improvements of 45.2%, where 45% is permitted; coverage by improvements within 140 feet of the front lot line of 48.2%, where 45% is permitted and gross building area within 140 feet of the front lot line of 37.3%/2,614 square feet where 35%/2,450 square feet is permitted at 82 John Street, Block 3501, Lot 6, in the R-1 Zone. (Continued from October 30, 2018. Carried from January 8, 2019 without further notice) Chairman Alegre and Mr. Lebow recused themselves from this hearing and left the meeting. Mr. Bandelt left the meeting. David Rutherford, Esq., was present on behalf of the applicant. Robert Inglima, Esq., was present on behalf of the objectors.
Roger Schlicht, architect, was previously sworn and testified as to the revised plans, revised to 2/15/19 and marked as Exhibit A-11. A 3 page schematic, comparing what was originally proposed and what is currently proposed, was marked as Exhibit A-12. Mr. Schlicht described the reductions and at the request of Mr. Inglima, reviewed each page of the plans in detail.
Mr. Inglima had questions regarding the comparison and asked about the revision from 8/31/18. Mr. Schlicht said the comparison was from the original drawings and Exhibit A-12 is an overview. Mr. Inglima questioned Mr. Schlicht about the existing and proposed elevations and the proposed variances and if there was a variance needed for the front yard setback. Mr. Schlicht said the Zoning Officer said a front yard setback variance was not being requested and reviewed the variances being requested.
Board members had questions about the size of the porch and the chimney vent which Mr. Schlicht clarified.
There were no questions from the public.
Mr. Rutherford stated the stipulations if the Board were to approve the application.
The following members of the public made statements opposing the application:

- Patricia Pechko, 965 E. Ridgewood Avenue
- Angela Radossi, 534 Wyndemere Avenue
- Anne Loving, 342 S. Irving Street
- Jacqueline Hone, 30 Carriage Lane
Mr. Inglima presented his summation to the Board.
Mr. Rutherford presented his summation to the Board.
Mr. Whitaker gave the Board instruction. Vice Chairman Brown asked for the Board to deliberate on the Appeal of the Assistant Zoning Officer’s decision. Following deliberation, Ms. Matthews made a motion to accept the Assistant Zoning Officer’s interpretation and opinion in her correspondence of October 22, 2018, Mr. Papietro seconded, and all eligible members voted yes.
Following Board discussion, the matter was carried to March 12, 2019 for deliberation and vote on the variances.
