Please note: A curfew of 11:00 PM is strictly adhered to by the Zoning Board of Adjustment of the Village of Ridgewood. No new matter involving an Applicant will be started after 10:30 PM. At 10:00 PM the Chairman will make a determination and advise Applicants as to whether they will be heard. If an Applicant cannot be heard because of the lateness of the hour, the matter will be carried over to a future meeting to be determined by the Board at 10:00 PM.

430 BOGERT AVE, LLC – An application to permit the construction of a two-story addition which will result in a side yard setback of 9.7 feet where 10 feet is the minimum required; rear yard setback of 23.7 feet, where 30 feet is the minimum required; coverage by above-grade structures of 23.4%, where 20% is the maximum permitted and a Gross Building Area of 44%/2,644 s.f., where 35%/2,856 s.f. is the maximum permitted at 430 Bogert Avenue, Block 3001, Lot 11, in an R-2 Zone.           New Business:

 

NICHOLAS & DANA FLYNN – An application to permit the construction of a one-story addition with two-car garage below and a covered open portico in front which will result in a front yard setbacks of 24.5 feet to the step and 31.8 feet to the addition, where 40 feet is the minimum required at 18 South Hillside Place, Block 2403, Lot 13, in an R-110 Zone.

 

RUBY NASKIEWICZ – An application to permit the widening of an existing driveway to 18 feet, where 12.08 feet is the maximum permitted which will result in coverage by improvements of 47%, where 45% is the maximum permitted at 239 Brookside Avenue, Block 4107, Lot 7, in an R-2 zone.

 

ERIK & LAURA STEPHENS – An application to enlarge an existing patio and to permit the construction of an outdoor kitchen, wall and fireplace, which will result in coverage by above-grade structures within 140 feet of the front lot line of 22.6%, where 20% is the maximum permitted and coverage by improvements within 140 feet of the front lot line of 49.6%, where 45% is the maximum permitted at 80 Crest Road, Block 2107, Lot 4, in an R-1 zone.

 

GUERRERO – An application to permit the construction of a two story single family dwelling on an existing foundation and deck which will result in a side yard setback of 16.2 feet where 19.8 feet is the minimum required, lot coverage within 140 feet of the front lot line of 24.3% where 20% is the maximum permitted (previously granted) and Gross Building Area within 140 feet of the front lot line of 40%/3,697.92 square feet, where 34%/3,360 square feet is the maximum permitted. Also proposed is a new two and a half car garage and carriage house which will result in Gross Building Area of 6%/1,200 square feet where 5%/1,000 square feet, is the maximum permitted and a height of 23 feet where 18 feet is the maximum permitted at 322 Van Emburgh Avenue, Block 4805, Lot 9, in an R-1 zone.

 

PAUL & MARTI RANKY –An application to permit the construction of a one-story addition with deck above which will result in coverage by above-grade structures located within 140 feet of the front lot line of 27.57%, where 20% is the maximum permitted at 226 Brookside Avenue, Block 4014, Lot 4, in an R-2 zone.

            New Business:

            121 FRANKLIN AVENUE ASSOCIATES – An application to permit use of the property located at 121 Franklin Avenue, Block 2010, Lot 16, as a drive-through Starbucks Coffee Shop, and to permit construction of an addition to the existing one story building. The applicant requests use variance approval to sell products outside the confines of the building. Additional variances being requested include a side yard setback for parking spaces of 3.5 feet where 5 feet is the minimum required, and sign variances. The property is located in an R-2 zone.

Zoning Board of Adjustment - 20160112

 

 

Opening:

 

The regular meeting of the Zoning Board of Adjustment of the Village of Ridgewood was called to order at 7:36 p.m.

 

Present:       Chairman Torielli, Diana Ruhl, Hans Lehmann, Gary Negrycz, Alyssa Matthews, Sergio Alegre, Ines Bunza and Greg Brown. Also present was Bruce Whitaker, Esq., Board Attorney.

 

Absent:        Jeffrey Voigt         

 

Approval of Minutes: The minutes from December 8, 2015 were approved as drafted.

Public hearings

 

Chairman Torielli announced that the Ivy Realty Services, LLC, 121 Franklin Avenue, application was carried to January 26, 2016 without further notice.

 

Chairman Torielli announced that the 210 S. Broad Street LLC, 210 S. Broad Street, application was carried to February 9, 2016 without further notice.

 

Old Business:

 

CAPITAL ONE BANK – An amendment to the application to permit construction of a new building for use as a bank – Scott Collins, Esq., representing the applicant, explained that the proposed changes to the previously approved site plan were a result of the comments from the County Planning Board. Noel Barnett, Professional Civil Engineer, was sworn and his credentials were accepted by the Board. Mr. Whitaker explained that the applicant is coming back to the Board with the proposed changes because that was a condition of the resolution.

Mr. Barnett explained the proposed changes on the site plan, revised to 10/18/2015. The minor changes included a 20 foot wide curb-cut for the ingress driveway; an easement of 35 feet from the center line, a roadway dedication easement which has been recorded with the County; sign changes regarding the ingress and egress; and the County will not approve a storm water connection to Godwin Avenue so the water was rerouted to the rain garden and small landscape changes because of the storm water connection change.

 

Mr. Whitaker asked if there were any new variances being requested due to the changes. Mr. Collins said there were not. Mr. Whitaker asked about the recommendations made by Mr. Brancheau, Village Planner, and Mr. Rutishauser, Village Engineer, in their reports regarding the revised plans. Mr. Bartlett stated that they would comply with any and all recommendations made by the Mr. Brancheau and Mr. Rutishauser.

 

There were no questions or comments from the public. After Board deliberation, Mr. Lehmann made a motion to approve the amendments to the application, Ms. Ruhl seconded, and all eligible members voted yes.

Discussion: There was discussion regarding who was eligible to hear the Ivy Realty Services, LLC application and who would be available for the January 26 meeting.

 

8:01 p.m. - There was a motion to go into Closed Session to discuss matters of pending litigation and the public meeting was closed.

 

9:05 p.m. - The public meeting was called back into session and the meeting was adjourned at 9:06 p.m.

In accordance with the provisions of the "Open Public Meetings Act," please be advised that the BOARD OF ADJUSTMENT public meeting and work session for TUESDAY, MARCH 29, 2016, in the VILLAGE HALL COURT ROOM, 4th Floor, 131 NORTH MAPLE AVENUE, RIDGEWOOD, NJ beginning at 7:30 p.m. has been cancelled.

 

The next regular meeting will be held on April 12, 2016 at 7:30 p.m. in the Village Hall Courtroom, 4thFloor, 131 North Maple Avenue, Ridgewood, NJ.

 

 All meetings of the Ridgewood Board of Adjustment (i.e., official public meetings, work session meetings, pre-meeting assemblies and special meetings) are public meetings which are always open to members of the general public.
